WAFIDIG / CLIENT INFORMATION
Terms of Service
Last updated:
Clear expectations for using our website and discussing work with WafiDig, including project agreements, data responsibilities, intellectual property, and service limitations.
01 / Using this website
These Terms of Service govern your use of the WafiDig website, including its informational content, portfolio, and project inquiry form. By using the website, you agree to these terms. If you do not agree, do not use it. You must be at least 18 and have authority to act for any organization you represent.
A website visit or inquiry does not create a paid engagement or obligate either party to proceed. Professional services require a separately accepted proposal, statement of work, or service agreement.
02 / Project scope and agreements
The written engagement agreement should define deliverables, milestones, fees, dependencies, review rounds, acceptance criteria, and each party’s responsibilities. If that agreement conflicts with these website terms on a matter relating to the engagement, the engagement agreement controls.
Changes to scope, additional revisions, ongoing maintenance, hosting, or support must be agreed separately where they are not already included. Delivery schedules depend on timely approvals, access, content, and third-party availability; any binding deadlines must be set out in the engagement agreement.
03 / Fees, payment, cancellation, and refunds
Pricing and payment obligations are established in the accepted engagement agreement or related invoice terms, not by a budget range selected in an inquiry. Deposits, taxes, advertising spend, software subscriptions, and other third-party costs should be identified before work begins.
Cancellation, termination, rescheduling, and any refund entitlement depend on the engagement agreement and applicable law. Do not assume that unused time, completed work, or committed third-party costs are refundable unless agreed or legally required. These terms do not limit any mandatory consumer cancellation or refund rights.
04 / Client responsibilities and permissions
Provide accurate information and timely feedback, and obtain the rights and permissions needed for materials, brand assets, accounts, customer information, and instructions you provide. You are responsible for the legality of your business, offers, claims, and content, including required disclosures and consents.
Give only the access reasonably needed for the work. Do not send passwords or sensitive data through the public contact form. Account access, credential sharing, approvals, and access removal should use an agreed secure process. Neither party should access third-party systems without authorization.
05 / Personal data, confidentiality, and security
Our Privacy Policy explains how this website handles personal information. Before client work involves personal data, the parties should define their respective responsibilities, authorized purposes, data categories, approved providers, retention and deletion expectations, security requirements, and any required data-processing agreement.
Confidential project information should be shared only through agreed channels and used for the engagement. Any special confidentiality commitments should be documented in the engagement agreement or a nondisclosure agreement. Do not submit trade secrets or highly sensitive information through the public inquiry form before suitable arrangements are in place.
Security is a shared responsibility. No service can guarantee complete protection from unauthorized access, outages, or data loss. Backups, security updates, monitoring, incident handling, and post-delivery maintenance responsibilities must be expressly allocated in the engagement agreement rather than assumed to be included indefinitely.
06 / Intellectual property and deliverables
WafiDig website content, design, branding, and original materials are protected by intellectual-property laws. You may view the website for lawful informational and business-evaluation purposes. Download availability does not grant a right to impersonate WafiDig, imply endorsement, or reuse branding in an unauthorized way.
Ownership or licensing of project deliverables, source files, pre-existing tools, and reusable components is determined by the engagement agreement. Do not assume that submitting an inquiry transfers any rights or that every component of a delivered solution can be exclusively owned. Third-party fonts, images, software, and other licensed assets remain subject to their respective licenses.
You retain your rights in materials you submit. Sharing a project brief allows us to review it and respond to your request; it does not automatically authorize public case studies, testimonials, or use of your brand. Publicity permissions should be agreed separately.
07 / Acceptable use and account safety
Do not use the website to submit unlawful, deceptive, infringing, or malicious content; send spam; impersonate others; interfere with normal operation; attempt unauthorized access; or collect personal information without permission. Do not exploit vulnerabilities or use automated requests in a way that harms availability or bypasses access restrictions.
If you have an account, keep your credentials secure and notify us of suspected misuse. We may restrict access or remove abusive content when reasonably necessary to protect the website, other users, or legal compliance.
08 / Service information and project results
Service descriptions are informational and do not replace an agreed project scope. Empty portfolio placeholders do not represent completed projects or client results. Published project information should be factual and approved for public use. Performance, business outcomes, uptime, and release timelines depend on technical and third-party factors and are not guaranteed by general website content.
Healthcare technology can support an organization’s security and HIPAA requirements, but technology alone does not establish compliance. Policies, safeguards, contracts, training, vendor eligibility, and configurations must also be considered. Apple and Google independently review mobile application submissions; store approval is not guaranteed.
09 / Third-party platforms and services
Advertising networks, hosting services, email providers, software vendors, and linked websites are independently operated and may impose their own fees, policies, licenses, and availability limits. We do not control their policy changes, account decisions, delivery outcomes, or outages.
Ownership and administration of advertising accounts, domains, analytics properties, and other project systems should be expressly identified in the engagement agreement. Third-party purchases or subscriptions are not automatically included in a service description.
10 / Website availability and disclaimers
We aim to keep website information useful and current but do not warrant that every item is complete, error-free, or continuously available. To the extent permitted by law, the website is provided “as is” and “as available.” We may update or discontinue website features. A submitted email reply does not guarantee delivery to a recipient’s inbox.
Professional-service warranties, support commitments, and service levels, if any, belong in the engagement agreement. These website disclaimers do not override those express commitments or rights that cannot lawfully be excluded.
11 / Liability and mandatory rights
To the extent permitted by applicable law, WafiDig is not liable for indirect or consequential losses, such as lost profits or opportunities, arising from reliance on general website content or third-party services. Any project-specific liability allocation or cap must be addressed in the engagement agreement.
Nothing in these terms excludes or limits liability, remedies, or statutory rights that cannot legally be excluded or limited. In particular, these terms do not waive protections applicable to fraud, willful misconduct, or other non-excludable liability.
12 / Disputes and applicable law
Please contact us first to discuss concerns and seek a practical resolution. The engagement agreement should identify any governing law, forum, and dispute-resolution procedure applicable to client work. These website terms do not impose mandatory arbitration or a class-action waiver.
Applicable mandatory law and any non-waivable rights in your jurisdiction continue to apply. If a provision is unenforceable, the remaining provisions remain effective to the extent permitted by law.
13 / Changes and questions
We may revise these website terms and will update the revision date shown on this page. Material changes will be communicated as required by law. Changes to website terms do not automatically rewrite an existing signed engagement agreement.
